Conditions of Sale
- We contract and do business solely upon the following conditions notwithstanding anything to the contrary or purported to be contained in any document or oral statement made by the party contracting with us and no variation or alteration of these conditions shall be of any effect unless expressly agreed to in writing by us.
- Quotations are subject to confirmation on receipt of order, and we reserve the right to amend errors and/or omissions on quotations or invoices.
- Both quoted and printed prices are based on manufacturers’ prices, rates of exchange, freight and insurance charges at the date of offer. In cases where these conditions change between the date of the quotation and the date despatched by us, the right is reserved to revise prices accordingly and to invoice at the price ruling at the time of despatch.
- Orders may be subject to a delivery and handling charge.
- With the exception of obvious errors and omissions, the prices served on the website for immediate purchase (web shop) and concluded in the payment system, will be honoured
- Sympathetic consideration will always be given to request for cancellation of orders and the acceptance for credit of equipment or services supplied, but this must be by agreement. We reserve the right to refuse to accept cancellation of orders for goods of special design or manufacture (as to which we shall be the sole judge). We also reserve the right to make a reasonable handling charge in respect of any items cancelled or returned. There is a non-refundable 50% booking fee for training courses, training course cancellations must be given in writing 7 days in advance of the course date in order for any refund to be issued. Hasman reserve the right to cancel training courses, a minimum of 7 days’ notice before delivery will be given if course bookings are not sufficient. In these instances full refunds will be given, or places on upcoming courses provided at no further cost.
- Orders and bookings are not reserved until full payment has been received, in cases where credit terms are agreed an official purchase order must be received by Hasman to reserve the order or booking.
- Training delegates must supply any prerequisite documentation prior to training attendance. Where information is not received Hasman retain the right to deny access to the candidate(s).
- Whilst every effort will be made to adhere to delivery dates we accept no liability in the case of non-delivery or delayed delivery. All deliveries offered ex-stock are subject to goods being available the date of receipt of order.
- Partial loss or damage in transit must be reported in writing to ourselves within three days of receipt of goods. In the event of non-delivery both carriers and ourselves must be notified in writing within fourteen days after date of advice of despatch.
- No claims for shortages or errors will be entertained unless notification is given in writing within three days of receipt of consignment.
- Our responsibility is limited to the supply of goods and services of the kind and quality ordered and insofar as is permitted by statute we hereby exclude all responsibility for any loss or damage howsoever caused consequential upon or resulting from the supply of such goods. Customers are recommended to test and examine goods and exercise special care in cases where the storage and/or use of the goods involves danger to persons and/or property, as required by the Health and Safety at Work Act 1974 and other current legislation.
- Articles sent to us for repair or service are accepted only on the understanding that, insofar as statute permits, we shall not be held liable for any damage howsoever caused to such articles. Time involved in preliminary examination of any articles may be charged in the event of no order being placed. Goods returned for repair or service should be sent carriage paid and clearly labelled with sender’s name and address; at the same time a letter should be sent detailing the work required. All requests for repair or service should be confirmed by an official order. After exchange, repair or service the item will be returned carriage forward to the customer.
- The guarantee period is one year from the delivery date unless otherwise specified. During this period the goods or apparatus will be repaired free of charge. We reserve the right to request articles for repair under warranty to be sent carriage paid to our service centre or other location in the UK as may be expedient. The time spent is free; spare parts will be repaired or replaced free of charge if defective. This guarantee does not cover damage to any goods or apparatus or any part thereof caused by misuse, or for any cause other than defective materials, nor replacement of certain consumable parts such as brushes, filters and flexible hoses. We decline any responsibility in cases where repairs have been carried out by persons unauthorised by the company, unless written consent has been given.
- Our normal hours are Monday to Friday 9am-5pm. During these hours repairs will be charged at our current rates (details on request). Work outside these periods will incur charges at overtime rates. Any spare parts will be charged at list prices.
- Should the rate of exchange for goods supplied, which are manufactured outside the United Kingdom, change appreciably from the quoted to printed price at any time before the date of our-invoice, we reserve the right to add a surcharge proportional to the change.
- If the manufacture or delivery of the goods is prevented or delayed by act of God, war, riot, civil disorder, strike, lockout, labour dispute, fire, accident, non-delivery of raw materials or any other contingency, beyond the control of the Company, the Company shall be under no liability for any loss or damage thereby incurred or sustained by the buyer.
- No returns or refunds of goods will be accepted after the point of delivery. Hasman Limited reserve the right to offer a buy back value for goods that are no longer required by vendor however this is at the total discretion of Hasman Ltd.
Site Service Specific Terms
- Labour: Supply site-based team of 2 staff to undertake works including all general consumables, PPE and RPE
- Hasman will require receipt of a purchase order or a written instruction before any works can be programmed or sites attended.
- All prices quoted will be inclusive of all labour, materials and conditions but exclusive of VAT.
- Prices are based upon Hasman having free access to hot running water, power and site welfare facilities.
- All prices quoted remain valid for thirty (30) days from the date of the quotation unless otherwise stated.
- All costs are based on the understanding that Hasman will have free uninterrupted 8-hour access to the site for each planned shift.
- Programming of Works will normally be agreed at the time of the official order. Subject to the programme, Hasman will be given complete and unhindered access to work areas. Failure to comply may lead to programme slippage and charges for waiting time.
- In the event of delays caused by factors beyond the control of Hasman no liability for compensation will arise to the Company.
- Should delays be forced upon Hasman by the action or inaction of the Client, his employees or third parties, Hasman will not be held responsible for any consequential over-run of time and liquidate damages. In addition, Hasman reserve the right to charge the Client for standing time or any additional associated costs incurred as a result of this delay.
- Should works be aborted within 48 hours of the agreed start date then an abortive fee may be raised for each allocated member of site staff at a rate of £375.00 Plus VAT, hired in plant costs will be charged at cost plus 5% for any incurred costs.
- Should the work programme be substantially delayed through circumstances beyond the control of either the Client or Hasman then interim payments to the value of the work completed to that date shall be payable under our normal invoicing terms.
- Furthermore, where the interruption is for a period of more than thirty (30) days then Hasman reserves the right to review our price on the works outstanding.
- Hasman will only accept responsibility for any advice or recommendations made, providing that these were in writing.
- In the event that the Client is dissatisfied with the work and/or the invoice, the Client must advise Hasman in writing immediately.
- Hasman carry third party insurance cover to the value of £10 million and liability for any damage or compensation will be restricted to this limit.
